Welcome to Balance & Awareness ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website and the online booking platform for massage and energy healing services (collectively referred to as "Services"). By accessing or using our website and booking services through it, you agree to abide by these Terms. Please read these Terms carefully before using our website or booking services.

1. Use of Services

1.1. Eligibility

 

You must be at least 18 years old to schedule our Services. By scheduling our Services, you represent and warrant that you are of legal age to form a binding contract.

 

1.2. Parental Consent

 

Any person under the age of 18, must have the parent schedule the appointment. Additionally, any person under the age of 18 must have a parent parent present during the time of the appointment or bring a signed parental consent form found on our "Forms" section.

 

1.3 Account Creation

 

To book services through our website, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and are solely responsible for all activities that occur under your account.

2. Booking Services

2.1. Availability and Accuracy

 

Our Services allow you to view available massage and energy healing appointments and schedule them based on your preferences. We strive to provide accurate and up-to-date information regarding service availability, but we do not guarantee the availability of specific appointments.

 

2.2. Payment

 

Booking a service requires payment. Payments are processed through secure third-party payment processors. You agree to provide accurate payment information and authorize us to charge the applicable fees to your chosen payment method.

 

2.3. Reschedules, Cancellations and Refunds

 

- No-shows will forfeit the full amount of the session scheduled.

- Rescheduling is allowable up to 1 hour prior to your scheduled appointment. Any reschedule within 1 hour prior to your appointment will be considered a "no-show".

- Cancellations are allowable up to 48 hours prior to your scheduled appointment, for a full refund. Any cancellation within the 48 hours prior to your scheduled appointment will forfeit 50% of their payment of that session. You will be refunded the remaining 50% of your payment for that session.

- Please call us for any special circumstances. Please note, we may be in session with another client when you call. Leave us a message and we will return your call as soon as we can.

2.4. Force Majeure


We are not liable for any failure or delay in performing our Services due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or other unforeseen circumstances.

3. Your Responsibilities

 

3.1. Health Considerations

 

If you have any medical conditions, allergies, or other health considerations, it is your responsibility to inform us before booking a session. Our massage and energy healing practitioners will use this information to ensure your safety and tailor the session to your needs. Please fill out the patient intake form found under the "Forms" section prior to your scheduled appointment. For returning clients, it is your responsibility to update your practitioner of any new or changing medical conditions, allergies, or other health conditions prior to you receiving your session. By booking a session, you confirm that you have disclosed all relevant health conditions, allergies, or concerns to your practitioner. Failure to do so may result in the refusal of service or liability for any adverse effects.

 

3.2. Conduct

 

You agree to behave respectfully and professionally during your sessions. Inappropriate behavior, harassment, or any actions that compromise the well-being of our practitioners or other clients will not be tolerated.

4. Intellectual Property

 

All content on our website, including text, images, graphics, and trademarks, are owned by Balance & Awareness or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works based on our content without our explicit permission.

5. Liability

 

5.1. Assumption of Risk


You acknowledge and agree that massage and energy healing services involve inherent risks, and you assume full responsibility for any consequences arising from your participation in these services. 

 

5.2 Limitation of Liability

To the extent permitted by law, Balance & Awareness and its owners, employees, and agents will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of our Services.

6. Changes to Terms

 

We may update these Terms from time to time. Any changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically for updates. Your continued use of our Services after any changes to these Terms constitutes your acceptance of the updated Terms.

7. Termination

 

We reserve the right to suspend or terminate your access to our Services at our sole discretion, including but not limited to violations of these Terms, inappropriate behavior, or failure to comply with health and safety guidelines.

8. Dispute Resolution


Any disputes arising out of or related to these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Santa Rosa County, Florida, and shall be governed by Florida law.

9. Gift Cards and Packages


Gift cards and service packages are non-refundable and may not be redeemed for cash. Gift cards expire one year from the date of purchase, and unused balances will be forfeited after the expiration date.
